Terms of Service

1. INTRODUCTION

Welcome to Strive. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Strive (“we,” “us,” or “our”) governing your use of the Strive mobile application (the “App”), including any content, functionality, and services offered on or through the App.

2. ACCEPTANCE OF TERMS

By downloading, accessing, or using the App, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

3. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. All changes are effective immediately when posted and apply to all access to and use of the App thereafter. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.

4. USER ACCOUNTS

4.1 Registration

To use certain features of the App, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your username or password.

4.3 Third-Party Authentication

The App allows you to authenticate using Google and Apple sign-in services. By using these services, you agree to their respective terms of service and privacy policies.

5. SUBSCRIPTION SERVICES

5.1 Subscription Plans and Pricing

The App offers the following subscription plans:

• Strive Premium Monthly: $12.99 USD per month. This plan auto-renews monthly and does not include a free trial.
• Strive Premium Annual: $69.99 USD per year (approximately $5.83 per month). This plan auto-renews annually and includes a 3-day free trial.

5.2 Auto-Renewal Terms

• All subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• The renewal cost will be $12.99 (monthly plan) or $69.99 (annual plan).
• Auto-renewal may be turned off in your iTunes Account Settings after purchase.
• No cancellation of the current subscription is allowed during the active subscription period.

5.3 Free Trial (Annual Plan Only)

The annual subscription plan includes a 3-day free trial. You will not be charged during the free trial period. However, if you do not cancel before the end of the trial, you will be automatically charged the annual subscription fee of $69.99 USD.

5.4 Cancellation Policy

You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

5.5 Price Changes

We reserve the right to adjust pricing for our services in our sole discretion. Any price changes will become effective at the end of the current billing period.

6. HEALTH AND FITNESS INFORMATION

6.1 Not Medical Advice

The App provides health, fitness, and wellness information for educational purposes only. The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a physician or other qualified health provider with any questions regarding a medical condition.

6.2 Health Data

You may have the option to connect the App with health platforms such as Apple Health. Any data shared with these platforms is subject to their respective privacy policies.

7. USER CONTENT

7.1 User-Generated Content

The App may allow you to create, upload, post, send, receive, and store content. By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, create derivative works based upon, distribute, and display your User Content.

7.2 Prohibited Content

You agree not to post content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 App Content

The App and its contents, features, and functionality are owned by Strive and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

9. PROHIBITED USES

You agree not to:

• Use the App in any way that violates any applicable law or regulation
• Use the App to advertise or offer to sell goods and services
• Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App
• Use any robot, spider, or other automatic device to access the App
• Introduce any viruses, Trojan horses, worms, or other material which is malicious or technologically harmful

10. TERMINATION

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. LIMITATION OF LIABILITY

IN NO EVENT WILL WE, OUR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Strive from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the App.

14. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Strive operates, without regard to its conflict of law principles.

15. DISPUTE RESOLUTION

Any dispute arising from these Terms will be resolved through binding arbitration conducted by a neutral arbitrator.

SPECIFIC APP PERMISSIONS AND DATA USAGE

Camera and Photo Library Access

The App requests access to your device's camera and photo library for features such as taking body scan pictures. We do not use these images for any purpose other than to provide you with the functionality you requested.

Health Data

With your permission, the App can access and write to your health data (through platforms like Apple Health) to track fitness progress including steps, workouts, and other activity metrics. This helps us provide personalized insights and track your fitness journey.

Notifications

The App uses notifications to send workout reminders, motivational quotes, and other relevant information to enhance your experience. You can control these through your device settings.

Face ID

On compatible devices, the App may use Face ID for authentication purposes. The biometric data is stored securely on your device and is not accessible to us.

User Tracking

The App may request permission to track your activity across other companies' apps and websites. This helps us deliver personalized advertising and measure the effectiveness of our marketing campaigns. You can control this permission through your device settings.
